Oppose Deployment of Military Lawyers in Immigration Courts
To: Sen. Peters, Rep. Moolenaar, Sen. Slotkin
From: A constituent in Rockford, MI
September 3, 2025
I am writing to express my deep concern over the Trump administration's plan to deploy up to 600 military lawyers (JAGs) to temporarily run immigration courts across the United States. This unprecedented move not only raises serious legal questions but also threatens the fundamental principles of our justice system and democratic norms. The proposed plan to use military lawyers in civilian immigration courts is problematic on multiple levels. First and foremost, it may violate the Posse Comitatus Act, which prohibits U.S. troops from participating in civilian law enforcement. This separation between military and civilian justice systems is a cornerstone of our democracy, and any erosion of this boundary sets a dangerous precedent. Furthermore, military lawyers typically have little to no experience with immigration law. The complexity and nuances of immigration cases require specialized knowledge and expertise. By placing inexperienced JAGs in these roles, we risk compromising the quality and fairness of immigration proceedings, potentially leading to unjust outcomes for those seeking asylum or facing deportation. Experts in military law, including Daniel Maurer, Rachel VanLandingham, and Mark Nevitt, have voiced their concerns about the legality and implications of this move. They argue that using military courts for civilian cases is a component of martial law, a prospect that should alarm every American citizen who values our constitutional rights and freedoms. The Justice Department's decision to relax its criteria for temporary immigration judges to accommodate this plan is equally troubling. This lowering of standards, coupled with the potential for indefinite extension of these temporary positions, could lead to a long-term undermining of our immigration court system. I urge you to take immediate action to oppose this plan and protect the integrity of our justice system. Please use your position to: 1. Publicly denounce the administration's proposal to use military lawyers in immigration courts. 2. Introduce or support legislation that reinforces the separation between military and civilian justice systems. 3. Call for hearings to investigate the legality and potential consequences of this plan. 4. Advocate for increased funding and resources for the existing immigration court system to address case backlogs through proper, civilian channels. The backlog in immigration cases is indeed a pressing issue, but the solution cannot come at the expense of our legal principles and democratic values. We must find ways to address this challenge that uphold the rule of law and respect the distinct roles of our military and civilian institutions. Your swift action on this matter is crucial. The implications of this plan extend far beyond immigration policy and touch on the very foundations of our democratic system. I look forward to hearing about the steps you will take to protect our justice system and oppose this unconstitutional overreach.
