Oppose Policies That Undermine Women's Rights Through Biological Definitions

To: Rep. Walberg, Sen. Peters, Sen. Slotkin

March 25

I'm asking you to oppose any legislation that defines sex through narrow biological criteria, including policies modeled on the so-called Women's Bill of Rights. These measures don't protect women. They threaten 50 years of sex discrimination protections for all of us. Legal historians warn that defining "female" based on reproductive biology gives conservatives a new strategy to dismantle anti-discrimination law. UC Davis professor Mary Ziegler explains that by anchoring sex to bodily differences, lawmakers could argue that treating men and women differently based on those differences doesn't violate equal protection. That opens the door to rolling back workplace protections for pregnant workers, excluding women from military academies, and worse. During Supreme Court arguments in January, Justice Amy Coney Barrett raised exactly this concern, asking whether states could use this logic to exclude women from calculus classes. This isn't hypothetical. Officials in the current administration have described gender roles as divinely ordained and opposed women in combat. Attacking trans rights undermines all women's rights. I need you to stand against these policies.
