The administration is actively considering suspending the writ of habeas corpus, a fundamental constitutional right that allows individuals to challenge their detention in court. This alarming move would undermine a core legal protection that has safeguarded liberty for centuries. Habeas corpus can only be suspended by Congress in cases of rebellion or invasion that threaten public safety, as explicitly stated in the Constitution. However, the courts have repeatedly rejected the administration's claims of an "invasion" at the border to justify harsh immigration policies. Suspending this critical right would be an egregious violation of due process and a disturbing authoritarian overreach of executive power. I urge you to forcefully defend habeas corpus and uphold this essential civil liberty that guards against unlawful imprisonment. The strength of our democracy hinges on preserving such fundamental rights and maintaining a system of checks and balances.
