This unilateral action aims to illegally overhaul major components of the nation's election systems, exceeding the constitutional authority of the executive branch. The order seeks to impose unnecessary and burdensome requirements, such as forcing citizens to produce passports or similar documents to register to vote, which would disenfranchise millions of eligible American voters. It also targets military and overseas voters with additional impractical burdens. Moreover, the order attempts to decertify voting machines previously certified by the bipartisan Election Assistance Commission, potentially disrupting election administration in 39 states without providing feasible alternatives. Granting private entities like DOGE access to sensitive voter data raises serious privacy concerns and risks interference with voter rolls. The order also seeks to coerce states into altering mail-in ballot deadlines and sharing confidential information, encroaching on states' authority over election administration. This executive overreach violates federal laws and the Constitution's clear delineation of powers over federal elections. The president lacks the authority to unilaterally rewrite election laws or dictate actions to an independent agency like the EAC.
