Oppose the Diversity Visa Rule Targeting Trans Immigrants

To: Sen. Hawley, Rep. Burlison, Sen. Schmitt

From: A constituent in Springfield, MO

March 24

I need you to oppose the Trump administration's new rule "Enhancing Vetting and Combatting Fraud in the Diversity Immigrant Visa Program" and work to block its enforcement. This rule weaponizes immigration law to target transgender people for harassment, detention, and deportation. The rule forces trans visa applicants to list their "biological sex at birth" even when it contradicts their passport, then uses that mismatch to declare applications fraudulent under 8 U.S.C. § 1182(a)(6)(C)(i). The State Department can revoke visas and initiate deportation proceedings against green card holders up to five years after they receive permanent residence. This puts every trans non-citizen in the country at risk, including students, workers, permanent residents, and tourists. Worse, this rule gives ICE agents justification to stop, question, and detain anyone who "looks" trans based on the Supreme Court's ruling last year allowing reasonable suspicion stops. Trans people, especially those from racial minority groups, now face racial profiling combined with gender profiling. Once detained, they face sexual violence and medication denial after ICE removed protections for trans detainees. This is state-sanctioned persecution. Block funding for enforcement of this rule and demand the State Department rescind it immediately.
