To: My Elected Officials
I am writing to urge the immediate introduction and passage of legislation that places strict statutory limits, oversight, and legal penalties on the White House Chief of Staff and senior unelected advisors, specifically barring interference with the Department of Justice (DOJ).
The Chief of Staff is meant to be an administrative coordinator, not an unchecked shadow executive. No unconfirmed advisor should be permitted to weaponize the West Wing to bypass federal laws, ignore judicial precedent, or pressure the DOJ and federal law enforcement into politically motivated or unlawful actions. When senior advisors act as accelerants for executive overreach, the rule of law and our constitutional checks and balances break down.
I urge you to pass ironclad legislation that:
• Protects DOJ Independence: Codifies strict limits prohibiting unconfirmed White House staff from directing DOJ investigations, prosecutions, or federal law enforcement deployments, requiring public logging of any West Wing-DOJ communications.
• Requires Senate Confirmation for any Chief of Staff or senior advisor exercising operational authority over federal agencies.
• Strictly Penalizes Unlawful Directives: Establishes clear legal liability, criminal or civil fines, and mandatory removal for any White House official who attempts to override Senate-confirmed Cabinet secretaries, bypass federal statutes, or defy court orders.
• Enforces Congressional Oversight: Prohibits the use of blanket executive privilege to shield senior advisors from congressional subpoenas regarding potential violations of law, DOJ interference, or breaches of constitutional precedent.
Unelected staff must never operate above the law or weaponize our justice system. I ask that you act immediately to codify these guardrails and restore constitutional accountability to the executive branch.
