Investigate the reported genital examination of Clara Tan, a transgender woman detained by ICE at Rochester's Frederick Douglass Greater Rochester International Airport in October, and take action to end this practice in federal detention facilities.
Tan alleges she was placed in a men's facility and subjected to an intimate physical examination after disclosing her surgical history. Federal Prison Rape Elimination Act standards explicitly prohibit searches conducted solely to determine genital status. If officials used her anatomy to decide how she was classified or when she was released, that is not a safety procedure. It is an invasive government inspection of a private body with no legitimate justification.
Bodily autonomy is not a special right for any one group. It is a foundational expectation that government interference with a person's body requires clear necessity and legal authority. Detention reduces freedoms, but it does not eliminate them. No one should have to submit to an intimate examination to prove their identity or earn humane treatment. My medical history is not public property, and neither is anyone else's.
