Impeachment Offense - Unconstitutional Usurpation of Congressional Powers

To: Sen. Gallego, Pres. Trump, Rep. Hamadeh, Sen. Kelly

From: A constituent in Sun City West, AZ

May 21

I am writing as your constituent to express my serious concern regarding President Donald Trump's actions that directly usurp powers constitutionally delegated to Congress. These violations of the separation of powers represent impeachable offenses that require immediate congressional attention. Since taking office in January 2025, President Trump has systematically encroached upon congressional authority in several significant ways: 1. Creating Extraconstitutional Positions of Authority: The President has established a position of authority with oversight of federal agencies and installed Elon Musk in this position without seeking the Senate's advice and consent as required by Article II, Section 2 of the Constitution. This circumvention of the constitutional appointments process undermines congressional oversight and accountability. 2. Defying Congressional Appropriations Authority: The President has blocked the distribution of trillions of dollars in funds that were lawfully appropriated by Congress under its exclusive constitutional authority granted by the Taxing Clause (Article I, Section 8, Clause 1) and the Appropriations Clause (Article I, Section 9, Clause 7). This action directly contravenes the Constitution's explicit grant of spending power to Congress. These actions represent a dangerous consolidation of power in the executive branch that the framers of our Constitution specifically sought to prevent through the careful balance of separated powers. By bypassing congressional authority in these areas, President Trump has violated his oath to "preserve, protect and defend the Constitution of the United States." The usurpation of congressional powers strikes at the heart of our constitutional system and meets the standard for impeachable offenses as "high Crimes and Misdemeanors." I urge you to support an immediate impeachment investigation into these violations. As James Madison wrote in Federalist No. 47, "The accumulation of all powers, legislative, executive, and judiciary, in the same hands... may justly be pronounced the very definition of tyranny." Congress must act as a check on executive overreach to preserve our constitutional order.
