Immediate Action Required: Checks and Balances Are Failing
To: Sen. Schumer, Sen. Gillibrand
From: A constituent in Brooklyn, NY
January 13
I am writing as a constituent because the constitutional system of checks and balances is visibly failing, and Senate inaction is accelerating that failure.
The current administration has demonstrated a pattern of acting above the law. Most recently, the Department of Justice Civil Rights Division declined to investigate the fatal shooting of Renee Good by an ICE officer. This decision breaks longstanding practice. The criminal section of that division normally investigates fatal law enforcement shootings and exists for precisely this purpose.
At the same time:
• Senior civil rights prosecutors have resigned.
• State investigators have been blocked from accessing evidence.
• DHS leadership has publicly defended the officer before an investigation concluded.
• DOJ leadership has declined to exercise oversight authority.
When executive power shields itself from investigation, Congress has a constitutional duty to respond.
The Senate is not powerless. Under existing rules, senators can act immediately by:
• Withholding unanimous consent
• Forcing full procedure on DOJ and DHS business
• Placing holds on nominations
• Demanding roll-call votes and quorum calls
• Conditioning appropriations on independent investigations and transparency
I am asking for clear answers, not statements of concern.
1. What procedural actions are you taking right now to impose accountability on DOJ and DHS?
2. Are you using Senate rules to slow or obstruct business as usual while democratic norms erode?
3. Will you support impeachment proceedings for officials who have abused their authority or failed to faithfully execute the law?
A government without enforcement of the law is not a functioning democracy. Silence and delay are not neutral acts.
I expect a substantive response detailing actions taken, not future intentions.
