Protect Transgender Rights in ACA Subsidy Negotiations

To: Rep. Huizenga, Sen. Slotkin, Sen. Peters

November 25

I am writing to express my deep concern about the potential inclusion of anti-transgender provisions in the ongoing negotiations to extend Affordable Care Act (ACA) subsidies. It has come to my attention that some Republicans are pushing for a Hyde Amendment-style provision that would prohibit federal dollars from covering gender-affirming care in ACA-subsidized plans. This proposal is not only discriminatory but also poses a significant threat to the health and well-being of transgender individuals who rely on these subsidized plans for essential care. The ACA subsidies currently benefit approximately 20 million Americans, including lower and middle-income families. Implementing restrictions on gender-affirming care would severely limit access to necessary medical treatments for transgender individuals within this group. Moreover, such a provision could potentially conflict with state laws that require coverage of gender-affirming care, creating a complex and unjust patchwork of healthcare access across the country. It is crucial to remember that gender-affirming care is recognized by major medical associations as medically necessary and life-saving for many transgender individuals. Denying access to this care through federal policy would be a step backward in our nation's progress towards equality and comprehensive healthcare for all. I urge you to stand firm against any attempts to include anti-transgender provisions in the ACA subsidy deal. The recent compromise to reopen the government did not include such measures, and it is vital that we maintain this stance in future negotiations. We must not allow the health and rights of transgender Americans to become bargaining chips in political negotiations. Please use your influence to ensure that any agreement on ACA subsidies protects the rights and healthcare access of all Americans, including our transgender community members. The integrity of our healthcare system and our commitment to equality are at stake. I ask that you publicly oppose any anti-transgender provisions and work diligently to keep such discriminatory measures out of the final ACA subsidy deal.
