Investigate Google for Breaking Privacy Promise to Users

To: Sen. May, Gov. Hochul, Assembly Member Magnarelli

From: A verified voter in Syracuse, NY

April 25

I'm asking you to investigate Google for deceptive trade practices after the company broke its decade-long promise to notify users before disclosing their information to law enforcement. For nearly a decade, Google has publicly promised billions of users on its Privacy & Terms page: "When we receive a request from a government agency, we send an email to the user account before disclosing information." But on May 8, 2025, Google gave ICE the personal data of Amandla Thomas-Johnson, a Ph.D. candidate targeted after attending a protest, and only notified him after the fact. Google had the subpoena for more than a month but chose what it calls "simultaneous notice" instead. Thomas-Johnson would have successfully challenged the subpoena if given advance notice as promised. This isn't an isolated mistake. Google's own counsel confirmed the company systematically breaks this promise when it doesn't meet government deadlines. How many other New Yorkers has Google deceived? Your office has the authority to stop deceptive business practices and seek restitution. Google must answer for this pattern of deception, especially when agencies like ICE are targeting people for First Amendment activity. Investigate this practice and hold Google accountable.
