I urge you to oppose HB6703, the Lower Health Care Premiums for All Americans Act, and instead prioritize extending the enhanced Affordable Care Act premium subsidies that are set to expire. While transparency in pharmaceutical pricing has merit, HB6703 creates substantial administrative burdens that could increase healthcare costs rather than reduce them. HB6703 requires group health plans and pharmacy benefit managers to submit detailed semi-annual reports on prescription drug spending, rebates, and compensation structures for plan years beginning January 1, 2027. Plans must track wholesale acquisition costs, manufacturer rebates, pharmacy fees, and out-of-pocket spending across multiple therapeutic classes and dispensing channels. This complex reporting infrastructure will impose significant compliance costs on health plans, which will likely be passed directly to consumers through higher premiums, undermining the bill's stated goal of lowering healthcare costs. The legislation imposes civil monetary penalties of up to ten thousand dollars per day for non-disclosure and one hundred thousand dollars for false information. These penalties could apply even to inadvertent errors in the complex reporting requirements, creating substantial financial risk for plans that will be reflected in premium pricing. More critically, HB6703 does nothing to address the immediate affordability crisis facing millions of Americans. The enhanced ACA subsidies have made health insurance accessible to working families who previously could not afford coverage. Allowing these subsidies to expire while pursuing untested transparency measures that may take years to show results, if any, represents a misplaced priority. I ask you to oppose HB6703 and focus legislative efforts on extending the enhanced ACA premium subsidies that have proven effective in reducing healthcare costs for constituents.
