Stop Political Prosecutions—Pass H.R. 7575 / S. 3874

I’m writing as your constituent to ask you to support the Prohibiting Political Prosecutions Act H.R. [7575] / S. [3874]. The rule of law requires that prosecutions be based on facts and lawful judgment—not political objectives, partisan retaliation, or improper selection. The recent cases described in the legislation’s own materials show why guardrails are needed. The Department of Justice has opened investigations and brought prosecutions described as targeting perceived political opponents—ranging from scrutiny of Democratic lawmakers for urging resistance to “illegal orders,” to investigative actions involving high-profile public officials after disputes with presidential preferences, and to widely reported efforts to pursue cases or indictments after nonpartisan career prosecutors concluded evidence was insufficient. In several of these instances, charges were dismissed after the process had already inflicted serious costs on the individuals involved and undermined public confidence in neutrality. I support protecting federal employees from disruptive or frivolous litigation. But accountability must match wrongdoing. That means preserving the ability to sue or otherwise obtain remedies when certain red lines are crossed: (1) when false information is knowingly supplied to federal prosecutors in a way that is material to initiating or maintaining a prosecution; (2) when the prosecution is initiated or pursued for political reasons; and/or (3) when constitutionally protected rights are impugned, including when due process is compromised. This bill is important because it seeks to constrain the government’s power at the point where it is most dangerous: the decision to investigate and to prosecute. Deterrence depends on the risk of consequences not only after convictions, but when misconduct is apparent before harm becomes irreversible. Please use your influence to get this bill out of the Judiciary Committee and onto the floor for a vote. In particular, I ask you to support the bill’s guardrails (including truthful certifications, heightened scrutiny for politically sensitive matters, and effective remedies for improper motive or knowing falsification) while maintaining safeguards for good-faith conduct so that legitimate prosecutions remain protected.
