An open letter to the U.S. Supreme Court

Demand Investigation into Supreme Court's Erosion of Constitutional Protections

I am writing to express my grave concern over the recent actions of the Supreme Court, which I believe are undermining the very foundations of our democracy and the rule of law. The Court's recent decisions, particularly following the appointment of three conservative justices during the Trump administration, have shown a disturbing trend towards enabling authoritarian policies and weakening constitutional protections. The Court's increased use of the 'shadow docket' to issue rulings without full briefings or arguments is especially troubling. This practice circumvents the transparent judicial process that has long been a cornerstone of our legal system. Moreover, recent rulings have disproportionately favored policies that many legal experts consider unconstitutional or dangerously authoritarian. For instance, the Court has allowed deportations to countries known to be dangerous, permitted immigration checks based solely on a person's language or occupation, and limited lower courts' ability to issue universal injunctions against potentially unconstitutional executive policies. These decisions not only jeopardize individual rights but also upset the delicate balance of powers between our government branches. The justification offered by some justices, such as Amy Coney Barrett and Brett Kavanaugh, that these decisions are "normal" is deeply concerning. It suggests a normalization of practices that erode long-standing legal protections and democratic norms. I urge you to take immediate action. We need a thorough, independent investigation into the Supreme Court's recent decisions and practices. This should include an examination of potential conflicts of interest, the use of the shadow docket, and the broader implications of these rulings on our constitutional framework. Furthermore, I ask that you support legislation to enhance judicial ethics standards, increase transparency in the Court's decision-making process, and potentially consider reforms to restore balance to our highest court. The integrity of our judicial system is at stake. Without swift action, we risk further erosion of the constitutional protections that have long safeguarded our democracy. I implore you to act now to preserve the rule of law and protect the rights of all Americans.
