I urge you to immediately block the Department of Homeland Security’s proposed acquisition and centralized handling of voter-registration and voter-history files by Immigration and Customs Enforcement’s Homeland Security Investigations division. Voter records are not to be used to create a national surveillance database.
ICE’s own acquisition forecast identifies a new “Public Voter Data and Handling” requirement, with an estimated value of $2 million to $5 million, an anticipated solicitation date of September 7, 2026, and contract completion by September 30, 2026. The stated purpose is to support HSI fraud-detection and analytical initiatives. However, the draft statement of work goes far beyond a narrowly tailored investigation. It contemplates acquiring annual voter-registration files and election-specific voter-history files from every state, the District of Columbia, U.S. territories, and other jurisdictions identified by the government. It also directs a contractor to provide the files to HSI, document their fields and limitations, and maintain a chain of custody. Most troubling, the draft states that DHS may issue “Government Interest” or “Need-to-Know” authorization letters allowing a contractor to obtain data that state law restricts from commercial access. In short, this proposal converts publicly available records into a nationwide federal surveillance resource. It could facilitate inaccurate voter investigations, intimidate eligible voters, undermine state election authority, and expose sensitive information through unnecessary centralization. Removing party-affiliation fields does not resolve these concerns.
Please use Congress’s appropriations and oversight authority to stop this initiative. Enact a binding appropriations rider prohibiting DHS, ICE, HSI, contractors, and data brokers from acquiring, aggregating, analyzing, sharing, or retaining voter-registration or voter-history data for immigration enforcement, citizenship screening, or generalized fraud investigations. Prohibit contractors from circumventing state restrictions through federal authorization letters. Require cancellation of any related solicitation or award, deletion of records already obtained, and public disclosure of all data-sharing agreements_
Please also hold oversight hearings, subpoena the procurement records, and require independent audits by the DHS Inspector General and Government Accountability Office before any further funds are spent.
