As your constituent, I urge you to demand the immediate removal of Department of Homeland Security (DHS) Secretary Markwayne Mullin and ICE Acting Director David Venturella from their positions due to their systemic failure to uphold the U.S. Constitution. The ACLU's report, Agents of Chaos, documents a pattern of unconstitutional conduct by DHS and its agencies that cannot be ignored.
The report reveals that DHS and ICE have engaged in widespread violations of the Fourth Amendment through warrantless home raids and pretextual traffic stops, including 76 cases of forcible removal from vehicles and 47 instances of agents smashing car windows without legal justification. These actions directly contradict the constitutional protection against unreasonable searches and seizures.
Furthermore, DHS has repeatedly fabricated charges against individuals to justify violence, violating the Fifth Amendment's due process protections. In multiple cases, charges were dismissed after video evidence disproved DHS's claims, yet no accountability has been enforced. The use of excessive force, including 22 shootings—many of unarmed individuals—and 14 cases of agents ramming vehicles into people, constitutes cruel and unusual punishment under the Eighth Amendment. Only one agent has faced prosecution for misconduct, demonstrating a culture of impunity within these agencies.
The First Amendment has also been violated, as agents have threatened and used force against individuals recording enforcement actions, suppressing transparency and accountability. Additionally, the report highlights racial profiling, with Latino communities disproportionately targeted in traffic stops and home raids across eight states, violating the Fourteenth Amendment's equal protection clause.
These violations are not isolated incidents but part of a broader policy of unconstitutional enforcement that disregards the rule of law. As your constituent, I respectfully demand that you take immediate action to remove Secretary Mullin and ICE Acting Director Venturella from their positions for their failure to uphold constitutional protections. I also urge you to support legislation establishing an independent oversight body for immigration enforcement and to call for hearings to investigate DHS's use of force and racial profiling.
What constitutional functions does ICE serve when it operates with unchecked power, weaponizes immigration enforcement against entire communities based on race and ethnicity, and acts as an instrument of political vendetta rather than lawful authority? How can the United States claim to uphold the Constitution while its immigration enforcement agencies operate with such pervasive impunity? If you intend to prioritize loyalty to the President's mass deportation campaign over your constitutional oath to uphold the rule of law, then I urge you to consider whether your constituents—including those whose families and livelihoods are devastated by unconstitutional enforcement—deserve representation that values their basic rights and dignity. Your constituents deserve to know whether you have chosen to abandon your oath to the Constitution in favor of implementing a mass deportation agenda using unlawful means, and if so, whether you accept full responsibility for the constitutional violations and human suffering that result.
