An open letter to the U.S. Congress

Either Strengthen The SECURE Data Act (HR 8413) Or Vote NO

I urge you to support strong federal privacy protections and meaningful limits on data brokers’ collection, sale, and use of personal information. The Senate Judiciary Subcommittee’s August 4 hearing, “Your Data, Their Profit: The Consumer Cost of AI Surveillance Pricing,” brought an urgent issue into focus: companies can combine behavioral data with AI tools to estimate what individual consumers may be willing to pay. Witnesses described data such as shopping and browsing history, payment information, device signals, and location as inputs to pricing decisions. This is not simply a matter of prices responding to broad changes in supply or demand. It is the use of personal profiles, sometimes assembled or inferred by third parties, to determine the price or offer shown to a particular person. Consumers may not know what information was used, who supplied it, whether the profile is accurate, or why another customer received a different price. That opacity undermines meaningful comparison shopping and makes it difficult to challenge unfair treatment. The SECURE Data Act, H.R. 8413, should not be treated as adequate simply because it creates a national framework. As drafted, it would preempt many state privacy protections, provide no private right of action, and leave significant gaps in data minimization and opt-out protections. Federal law should establish a strong floor that states can build upon, not a ceiling that erases stronger safeguards. Consumers also need meaningful ways to enforce their rights, not protections that depend solely on regulators having the resources to act. Please support legislation that limits the collection and sale of sensitive personal data, requires clear disclosure and meaningful consent when personal data is used to set individualized prices, and gives people practical rights to access, correct, delete, and opt out of data-broker profiles. Require data brokers to register and disclose their sources and customers, and empower regulators and individuals to hold violators accountable. Protect legitimate price changes tied to costs, inventory, or general demand, while prohibiting hidden personal dossiers from determining what a person pays for essential goods. Americans should not have to surrender control of their information to receive fair and transparent prices. Please make strong privacy protections and data-broker accountability a priority.
