Restore Balance to the Judicial Standards Commission (HB 1236)

As your constituent, I urge you to support House Bill 1236 to restore balance, impartiality, and public confidence in North Carolina’s Judicial Standards Commission. North Carolinians expect a fair and independent judiciary insulated from partisan pressure. Recent changes that gave the General Assembly outsized influence over the commission have opened the door to what many perceive as political weaponization—complaints and public campaigns aimed at chilling judges who express views on core issues like reproductive freedom. HB 1236 would correct that course by removing legislative appointments and reestablishing a tripartite, professionally balanced commission: five judges appointed by the chief justice, five attorneys appointed by the State Bar, and five non-lawyer, non-judge citizens appointed by the governor. That structure better aligns with best practices for oversight bodies by combining judicial experience, legal expertise, and civic representation while reducing direct partisan control. A commission composed primarily of legal professionals and impartial citizens will improve the quality and credibility of disciplinary reviews, helping ensure complaints are evaluated on legal and ethical merits rather than political convenience. Restoring State Bar-appointed attorneys ensures disciplinary decisions draw on professional standards and ethics; judicial members bring procedural and institutional context; and citizen members preserve public accountability and trust. Removing General Assembly appointments decreases direct partisan influence and the appearance that disciplinary tools may be used as weapons in judicial elections. HB 1236 also supports judicial independence, a foundational element of our constitutional system that protects rights and equal treatment under law. When judicial officers fear reprisal for principled rulings or constitutionally grounded public statements, the public loses confidence in courts’ ability to administer justice impartially. Rebalancing the commission reduces that risk, encouraging judges to decide cases based on law and conscience rather than political calculus. For the sake of functional, impartial courts and the preservation of public trust, please vote to pass House Bill 1236. This legislation is a measured, commonsense reform that restores professional balance to the Judicial Standards Commission and helps safeguard North Carolina’s judiciary from partisan exploitation.
