Oppose ICE Funding Until Fourth Amendment Violations End

I am writing to demand immediate action regarding an internal ICE memo issued in May 2025 that authorizes agents to enter homes without judicial warrants. This directive represents a flagrant violation of the Fourth Amendment, which protects all people from unreasonable searches and seizures and requires judicial warrants based on probable cause. The memo permits ICE agents to enter residences of individuals subject to final deportation orders without consent, using a necessary and reasonable amount of force, based solely on Form I-205. This is an administrative warrant issued by ICE or the Department of Homeland Security, not a judicial warrant issued by a judge. As David Kligerman, senior vice president and special counsel at Whistleblower Aid, stated, no previous administration has crossed this constitutional red line and no court has ever found that ICE agents have such legal authority to enter homes without a judicial warrant. This policy has already been used to train new ICE officers despite contradicting other agency training materials. Multiple DHS employees have been reprimanded for raising concerns about the document, and at least one instructor resigned rather than teach this directive. There are documented examples of ICE and federal immigration officials entering homes without valid judicial warrants, including homes of United States citizens. Legal experts across the political spectrum have condemned this memo. Georgetown Law professor Steve Vladeck characterized it as representing massive, systemic Fourth Amendment violations. Former United States Attorney Joyce Vance declared it clearly unlawful conduct. The ACLU stated that due process is not optional and called this a massive overreach of power. I urge you to vote against any ICE funding until this unconstitutional directive is rescinded, the agency is thoroughly overhauled, and concrete guardrails are established to prevent future Fourth Amendment violations. Our constitutional protections cannot be negotiable. This must stop now.
