Codify EMTALA: Protect emergency abortion access and womens' lives

To: Sen. Warren, Sen. Markey, Rep. Trahan

June 7

The Trump regime's rescission of EMTALA guidance jeopardizes emergency abortion care and endangers the lives of pregnant people. This federal law has safeguarded pregnant patients' access to life-saving and health-preserving abortion procedures when confronting medical crises. By removing clarity on hospitals' obligations, this regime has blatantly disregarded medical expertise and caved to anti-abortion extremists.   This reckless action will breed widespread confusion among providers, leading to unconscionable delays and denials of critical care, and inevitably, preventable suffering and loss of life. We cannot tolerate policies that force doctors to violate their sworn duty to save lives. The prospect of pregnant women hemorrhaging or enduring life-threatening complications while providers stand idly by awaiting legal guidance is utterly unacceptable.   Congress must take immediate action to reaffirm the right to emergency abortion enshrined in EMTALA and protect the well-established standard of care. Reproductive freedom and bodily autonomy are at stake, with far too many lives hanging in the balance. The highest legislative priority must be to eliminate ambiguity that could result in hospitals turning away pregnant patients in urgent medical distress, preventing unconscionable tragedies.
