For the last four months, this administration has been stripping away laws, rights, and protections under the claim that such things can be ignored during times of war and/or invasion. On March 15, the White House published a Presidential Action entitled "Invocation of the Alien Enemies Act Regarding the Invasion of The United States by Tren De Aragua," which declared that "Tren de Aragua (TdA) is a designated Foreign Terrorist Organization with thousands of members, many of whom have unlawfully infiltrated the United States and are conducting irregular warfare and undertaking hostile actions against the United States." It is notable that the declaration itself is contradictory.First, it claims that Tren de Aragua is acting as a quasi-government in Venezuelan territories. But it also claims that TdA has infiltrated the current regime. On March 19, White House press secretary Karoline Leavitt said that Tren de Aragua was sent by the Venezuelan government. "“A predatory incursion is absolutely what has happened with Tren de Aragua, they have been sent here by the hostile Maduro regime in Venezuela,” she said. In other words, the Trump administration is claiming both the gang is the government and the gang is independent of the government. And they did so in the same document. If war has been declared on the United States, prompting the dubious Alien Enemies Act and the suspension of due process and habeas corpus, then America should know it with certainty. Under the United States Constitution, Congress has the sole authority to declare war. It is long past time, then, for Congress to stand up and do its job. As our representative, it is your job to demand an investigation into if, in fact, the United States of America is being invaded. If so, we as a nation should declare a defensive war. If not, then we should stop using a baseless argument to suspend Constitutional freedoms.
