My mom is a disabled veteran who was appointed a fiduciary even though she is not incompetent. Her income from her benefits is around $3800 per month. Her fiduciary until October was only assigned by the hub to pay around $400/month and since October now $1200/month. The hub claims my mom’s benefits can’t be used to help me as the VA designated dependent. So they refused to reimburse her money from funds they withheld when her car had a mechanical issue that needed repair because “your daughter drives it.” TO MEDICAL APPOINTMENTS. I am her dependent! The fiduciary responsibility number 1 outlined in the law is to use the veteran’s funds for both the veteran and the dependents. They were sending her $2600/month when it was only $400/month being used. Now they only send her $2000/month with $1200/month being used because they are supposed to cover utilities even though the utilities said they do NOT allow third party payers. The amount of money withheld from my mom from her benefits to date THIS YEAR is $7200!!!! Even if the fiduciary pays herself $150/month and has maybe $80/month for checks, where is the rest of my mom’s money?!? With the amount of money that has gone missing from her benefits, we could have paid off two credit cards or gotten necessary home repairs that could get my mom transferred to closer to home sooner. My mom filed complaints with the OIG but when they investigated they only talked to the fiduciary not my mom and the fiduciary LIED. The money is MISSING! The fiduciary STOLE it. It has NOT been used for my mom’s needs. They refuse to care for the dependents! The VA fiduciary program is responsible for FRAUD and homeless veterans/veteran families!!! The Louisville hub should not be investigating itself. And the fiduciaries should NOT be abusive to the veterans. There needs a better mechanism of investigating FRAUD and my mom’s money needs to be returned to her! She is supposed to see a psychiatrist to try to get her declared competent again. Because she has been competent for a while now. The fiduciary accusing my mom of harassment because she has been investigated is inappropriate. The fiduciary had already told me as the dependent that she did not care if her actions caused me to be dead on the street. That I will NEVER ever forgive or forget. And by the fiduciary withholding that much of my mom’s money, that very well could happen because we cannot afford to repair our house without the money or afford the air conditioning the house needs - I could die of heat stroke in the summer. If the car breaks down again, I could die because I can’t get to my infusions. We demand the fiduciary release the money that has gone missing from my mom’s benefits. We are NOT stupid.
