Finalize PBM Reform to Address Cost and Access of Prescription Drugs

As someone with family members who rely on prescription medications to manage their health, I want to urge you to finish the job and pass robust PBM reform. PBMs hinder access to prescription drugs at the community pharmacy of choice and often inflate out-of-pocket costs by favoring higher cost medications and pocketing rebates, and PBMs also increase taxpayer costs in government programs. Fortunately, meaningful bills are making their way through the legislative process in both houses of Congress with overwhelming bipartisan support to address many of these abusive practices. Please ensure these efforts result in the swift passage of a meaningful bill that can be signed into law. The following bills are proceeding through regular order and have received overwhelming bipartisan support on the floor or in their committees of jurisdiction: • S. 2973, the Modernizing and Ensuring PBM Accountability (MEPA) Act (passed 26-1 out of the Senate Finance Committee)/H.R. 5378, the Lower Costs, More Transparency Act (passed the House of Representatives on an overwhelming bipartisan vote of 320-71) o Bans spread pricing in Medicaid managed care by requiring a fair and transparent reimbursement to pharmacies and saves over $1 billion! • S. 3430, Better Mental Health Care, Lower-Cost Drugs, and Extenders Act (unanimously passed the Senate Finance Committee) o Includes the No PBMs Act which requires CMS to define reasonable and relevant contract terms in Medicare. o Requires PBMs to pass negotiated discounts to patients at the pharmacy counter instead of pocketing them. With overwhelming bipartisan support, Congress must not miss this opportunity to immediately pass a comprehensive and meaningful PBM reform bill that ensures patients maintain access to the pharmacy of our choice and that we are not overpaying for our medications.
