Justices Alito and Thomas must recuse themselves from all cases related to the January 6th insurrection and efforts to overturn the 2020 election results due to their personal involvement and public statements revealing bias. As Rep. Jamie Raskin outlines, their participation would violate the federal recusal statute (28 U.S.C. 455) which requires judges to disqualify themselves when their impartiality might reasonably be questioned. Thomas actively worked to block the peaceful transfer of power, while Alito appeared at an event hosted by a leader of the January 6th attack, crossing ethical lines. Their continued involvement irreparably compromises public confidence in the court's legitimacy and adherence to the rule of law without prejudice or political agenda. Voluntary recusal is insufficient - their clear conflicts of interest demand mandatory disqualification to uphold judicial integrity.
