Please reacquaint yourself with USC Title 18 section 242. ICE has been PERSISTENTLY *VIOLATING* THAT LAW, both by the actions of its agents and the orders and policies handed down by superiors. Yes, ICE agents and those who give orders are in CONTRAVENTION OF THAT LAW *every time* they refuse due process, deny habeas corpus, or use excessive force. Here's the DOJ website summary-- (note that the summary quoted below and the words of the statute can be found in full here: https://www.justice.gov/crt/deprivation-rights-under-color-law ) "Section 242 of Title 18 makes it a crime for a person acting under color of any law to willfully deprive a person of a right or privilege protected by the Constitution or laws of the United States. For the purpose of Section 242, acts under "color of law" include acts not only done by federal, state, or local officials within their lawful authority, but also acts done beyond the bounds of that official's lawful authority, if the acts are done while the official is purporting to or pretending to act in the performance of his/her official duties. Persons acting under color of law within the meaning of this statute include police officers, prisons guards and care providers in public health facilities, and others who are acting as public officials. It is not necessary that the crime be motivated by animus toward the race, color, religion, sex, handicap, familial status or national origin of the victim. The offense is punishable by a range of penalties--imprisonment up to a life term, or the death penalty, depending upon the circumstances of the crime, and the resulting injury, if any." Note: Deprivation of rights: The action must violate a specific right protected by the U.S. Constitution or federal laws (such as the right to due process, equal protection, or protection from excessive use of force). Penalties Sentences escalate in severity depending on the outcome of the offense:Standard violations: Fines and/or up to 1 year in prison.Bodily injury or use of a weapon: Fines and/or up to 10 years in prison.Resulting in death, kidnapping, or aggravated sexual abuse: Life in prison or the death penalty." The world has seen ICE regularly refusing due process, disregarding habeas corpus, using excessive force on both their victims and protesters, and defying the law that gives members of Congress the right to inspect facilities. I ask you enable and assist the flagrant regular lawbreaking committed by ICE. It is intolerable that members of Congress who swear to support and defend the constitution would appropriate funds to CRIMINAL ACTIVITY by a federal agency. Please: --NO FURTHER FUNDS for ICE --HOLD Hearings, compel testimony and --MAKE criminal referrals Use all the tools available to you: Please, use your platform to CONDEMN all ICE-perpetrated violations of the law, inherent contempt and any other tools. -- investigate and IMPEACH agency heads who are complicit in violating USC title 18 section 242 I count on you to honor your oath to the constitution and to uphold it as well as federal law.
